Los derechos fundamentales como límite constitucional al ejercicio de la función jurisdiccional de las rondas campesinas en el Perú

Abstract
El estudio tuvo como objetivo general determinar cuál es el marco de interpretación de los
derechos fundamentales, como límite Constitucional, al ejercicio de la función jurisdiccional
de las rondas campesinas en el Perú.
Además, estuvo basado en un enfoque cualitativo, de diseño no experimental y de tipo
explicativo, en cuanto a las técnicas se hizo uso del análisis documental y de la entrevista,
siendo los instrumentos la ficha de análisis y la guía de entrevista. La población estuvo
compuesta por 12 documentos extraídos de portales académicos referentes a las variables de
estudio; además de 14 entrevistas a los dirigentes de las rondas campesinas de las provincias
de San Ignacio y Jaén, de la Región Cajamarca.
Dentro de los resultados se advierte que existe vulneración de los derechos fundamentales
por parte de las rondas campesinas, ello producto del desconocimiento de las normas en
algunos casos y en otros por el propio comportamiento de sus integrantes.
En las conclusiones, se determinó que las rondas pueden ejercen funciones jurisdiccionales
basados en el derecho consuetudinario, no obstante, deben respetar en forma irrestricta los
derechos fundamentales normados en la Carta Magna, entre los cuales se tiene, el derecho a
la vida, la dignidad humana y la legalidad del proceso.
The general objective of the study was to determine the framework of interpretation of fundamental rights, as a Constitutional limit, to the exercise of the jurisdictional function of the peasant patrols in Peru. Furthermore, it was based on a qualitative approach, with a non-experimental design and explanatory type. Regarding the techniques, documentary analysis and interviews were used, the instruments being the analysis sheet and the interview guide. The population was made up of 12 documents extracted from academic portals referring to the study variables; in addition to 14 interviews with the leaders of the peasant patrols in the provinces of San Ignacio and Jaén, in the Cajamarca Region. Among the results, it is noted that there is a violation of fundamental rights by the peasant patrols, this is a result of ignorance of the rules in some cases and in others due to the behavior of their members. In the conclusions, it was determined that the rounds can exercise jurisdictional functions based on customary law, however, they must unrestrictedly respect the fundamental rights regulated in the Magna Carta, among which are the right to life, dignity human and the legality of the process.
