Abstract
La presente investigación tuvo como objetivo demostrar que la implementación de libros societarios electrónicos, coadyuva al mejor ejercicio del derecho a la información de los socios, en el marco del Gobierno Electrónico. Para ello, se investigó a las sociedades, sus socios, y a la ley que las regula en el Perú, Ley General de Sociedades - Ley 26887, utilizando los métodos inductivo–deductivo, analítico-sintético, comparativo, teleológico, hermenéutico-jurídico e histórico, así como técnicas de acopio documental e interpretación normativa. En ese mismo sentido, se realizó un abordaje metodológico basado en el análisis y comparación de legislación societaria de España, Argentina y Colombia. De este modo se pudo demostrar que sí es necesaria la implementación de libros societarios electrónicos, puesto que actúan como una modalidad coadyuvante al mejor ejercicio del derecho a la información de los socios, en el marco del gobierno electrónico.
ABSTRACT The objective of this research was to demonstrate that the implementation of electronic corporate books contributes to the better exercise of the right to information of the partners, within the framework of e-government. For this, the companies, their partners, and the law that regulates them in Peru, General Law of Companies (Ley General de Sociedades - Ley 26887), were investigated, using inductive-deductive, analytic-synthetic, comparative, teleological, hermeneutical-legal and historical methods, as well as collection techniques. documentary and normative interpretation. Likewise, a methodological approach was carried out based on the analysis and comparison of the corporate legislation of Spain, Argentina and Colombia. In this way, it was possible to demonstrate that the implementation of electronic corporate books is necessary, since they act as a contributing modality to the better exercise of the right to information of the partners, within the framework of e-government.
