Abstract
La presente tesis titulada “El delito de agresiones contra mujeres e integrantes familiares y la vulneración al principio de proporcionalidad de las penas”, tiene como finalidad demostrar que la pena impuesta para el delito de agresiones contra la mujer e integrantes familiares quebranta al principio de proporcionalidad de la pena conforme a los estándares constitucionales de un Estado democrático de Derecho, al no existir una correspondencia entre la afectación al bien jurídico tutelado y la pena impuesta por el legislador. En consecuencia, se pretende abordar los alcances del referido principio, y la incidencia que tiene su aplicación respecto al delito de agresiones contra la mujer e integrantes familiares. Para tal fin, se ha desarrollado la necesidad de imponerse una pena justa y equitativa en correspondencia con los hechos descritos en el tipo penal, así como la aplicación de una política criminal integral. La presente investigación se divide en tres capítulos, de los cuales el primero está referido al marco teórico, donde se desarrollan las bases teóricas del delito y el principio materia de investigación; el segundo, al marco metodológico, que sustenta el tipo de investigación realizado y los métodos utilizados; y el último, contiene los hallazgos finales, su consecuente discusión, conclusiones y recomendaciones.
ABSTRACT The purpose of this thesis entitled "The crime of assaults against women and family members and the violation of the principle of proportionality of the punishments" is to demonstrate that the punishment imposed for the crime of assaults against women and family members violates the principle of proportionality of the punishment according to the constitutional standards of a Democratic Rule of Law, since there is no correspondence between the affectation of the protected legal good and the punishment imposed by the legislator. Consequently, we intend to approach the scope of the aforementioned principle, and the incidence of its application with respect to the crime of assaults against women and family members. To this end, we will develop the need to impose a fair and equitable punishment in correspondence with the facts described in the criminal type, as well as the application of a integral criminal policy. This research is divided into three chapters, the first of which refers to the theoretical framework, where the theoretical bases of the crime and the principle under investigation are developed; the second, to the methodological framework, which supports the type of research carried out and the methods used; and the last contains the final findings, their consequent discussion, conclusions and recommendations.
