dc.description.abstractLa presente tesis titulada: “La Protección de los Derechos del Usuario en el Procedimiento “Trilateral Sancionador” de SUSALUD””, se centra en la reglamentación del procedimiento sancionador establecido en el artículo 11° del Reglamento de Infracciones y Sanciones de la Superintendencia Nacional De Salud – SUSALUD, aprobado por Decreto Supremo Nº 031-2014-SA. Siendo el propósito de la misma, determinar que este procedimiento no garantiza la efectiva protección de los derechos del usuario que acceden al servicio de salud; puesto que, se pretende unificar dos procedimientos que tienen fundamentos y finalidades diferentes y su regulación no ha sido efectuada con sujeción a las disposiciones que establece el Texto Único Ordenado de la Ley N° 27444 –Ley del Procedimiento Administrativo General, aprobado por Decreto Supremo N° 004-2019-JUS, lo cual constituye una vulneración a los principios de legalidad y de jerarquía normativa. Para analizar esta problemática, se ha distribuido los temas materia de estudio en seis capítulos, siendo que en el primer capítulo se desarrolla lo referido derecho a la Salud, en el segundo capítulo se aborda el procedimiento administrativo, el tercer capítulo se ocupa del procedimiento administrativo trilateral, en un capítulo cuarto se analiza el procedimiento administrativo sancionador, en el quinto capítulo se analiza la potestad sancionadora de SUSALUD y finalmente en el sexto capítulo se realiza el estudio de un caso práctico tramitado ante esta entidad.
dc.description.abstractABSTRACT This thesis entitled: "The Protection of User Rights in the SUSALUD" Trilateral Sanctioning Procedure "", focuses on the regulation of the sanctioning procedure established in article 11 of the Regulation of Infractions and Sanctions of the National Superintendence of Health - SUSALUD, approved by Supreme Decree No. 031-2014-SA. Being the purpose of the same, to determine that this procedure does not guarantee the effective protection of the rights of the user who access the health service; since, it is intended to unify two procedures that have different foundations and purposes and their regulation has not been carried out subject to the provisions established in the Single Ordered Text of Law No. 27444 - Law of General Administrative Procedure, approved by Supreme Decree No. 004-2019-JUS, which constitutes a violation of the principles of legality and normative hierarchy. To analyze this problem, the topics under study have been divided into six chapters, with the first chapter developing the right to Health, the second chapter dealing with the administrative procedure, the third chapter dealing with the administrative procedure trilateral, in a fourth chapter the administrative sanctioning procedure is analyzed, in the fifth chapter the sanctioning power of SUSALUD is analyzed and finally in the sixth chapter the study of a practical case processed before this entity is carried out.
