Fundamentos jurídicos para el pago por labores en descanso semanal obligatorio en la jornada laboral atípica en Cajamarca

Abstract
El presente trabajo tiene como objetivo determinar los fundamentos jurídicos que otorgan el derecho al pago por labores en Descanso Semanal Obligatorio en la Jornada laboral Atípica en el Distrito Judicial de Cajamarca, en base al pronunciamiento emitido por el TC a través de la STC en el Exp. N° 4635-2004-AA/TC, el Art. 25° de la CPP y el Art. 3° del D.L. No. 713, motivo por el cual para determinar dichos fundamentos; se ha definido el Descanso Semanal Obligatorio en la Jornada Laboral Atípica doctrinaria y normativamente, así como también se ha hecho un análisis de las STCs de primera instancia emitidas por el Primer y Tercer Juzgado especializado laboral y STCs de vista emitidas por la Primera Sala Laboral del Distrito Judicial de Cajamarca, asimismo, se realizó entrevistas a los magistrados y especialistas legales de la Corte Superior de Cajamarca. Los resultados permiten concluir que el principal fundamento jurídico para otorgar el pago por labores en descanso en Jornada Laboral Atípica, es el lineamiento emitido por el TC, principios laborales y verificación de medios probatorios que denoten el goce efectivo de los descansos, los cuales no son presentados por el empleador o reflejan que el trabajador no gozó realmente la totalidad de días que le correspondía descansar.
ABSTRACT The present research work aims to determine the legal foundations that grant the right to payment for work during mandatory weekly rest periods in atypical working hours in the Judicial District of Cajamarca. This is based on the pronouncement issued by the Constitutional Court through the ruling in Exp. No. 4635-2004-AA/TC, Article 25 of the Political Constitution of Peru, and Article 3 of Legislative Decree No. 713. To establish these foundations, mandatory weekly rest in atypical working hours has been defined both doctrinally and normatively. Additionally, an analysis has been conducted of the first-instance rulings issued by the First and Third specialised labour courts, as well as the appellate rulings from the First Labour Chamber of the Judicial District of Cajamarca. Furthermore, interviews were carried out with agistrates and legal specialists from the Superior Court of Cajamarca. The results lead to the conclusion that the main legal basis for granting payment for work performed during rest periods in atypical hours is the guidance issued by the Constitutional Court in Exp. No. 4635-2004-AA/TC, alongside labour principles and the verification of evidence that demonstrates the actual enjoyment of rest periods, which are either not presented by the employer or indicate that the worker did not genuinely benefit from the full number of days they were entitled to rest.
