Fundamentos jurídicos de una reforma constitucional para la aplicación del control difuso administrativo

Abstract
Se investigó cuáles son los fundamentos jurídicos de una reforma constitucional para la aplicación del control difuso administrativo; dicha investigación fue llevada a cabo mediante el acopio y análisis del marco teórico relacionado con las variables de estudio, el cual contiene definiciones y conceptos utilizados en el tema; asimismo, del estudio de una muestra conformada por los art 38, 51 y 138 la Constitución política de 1993; así como por las sentencias del Tribunal Constitucional : la STC 3741-2004-AA-TC y STC 4293-2012-AA-TC; y por las sentencias CIDH: Caso masacres de el Mozote y lugares aledaños vs. El Salvador, sentencia de 25 de octubre de 2012; Caso de personas dominicanas y haitianas expulsadas vs. República Dominicana, sentencia de 28 de agosto de 2014; Caso masacre de Santo Domingo vs. Colombia, sentencia de 30 de noviembre de 2012; y Caso Norín Catrimán y otros (dirigentes, miembros y activista del pueblo indígena mapuche) vs. Chile, sentencia de 29 de mayo de 2014. Los datos obtenidos se organizaron en tablas y figuras para su discusión con los métodos generales de la ciencia y particular del derecho; teniendo como conclusión principal que los fundamentos jurídicos de una reforma constitucional para la aplicación del control difuso administrativo son: la delimitación de la justicia, la argumentación jurídica del Tribunal Constitucional en las sentencias, el derecho convencional en la comunidad internacional de estados y una propuesta de reforma constitucional para aplicar el control difuso administrativo en el estado peruano, por lo que la hipótesis fue verificada.
The legal foundations of a constitutional reform for the application of diffuse administrative control were investigated; This research was carried out through the collection and analysis of the theoretical framework related to the study variables, which contains definitions and concepts used in the topic; Likewise, from the study of a sample made up of articles 38, 51 and 138 of the Political Constitution of 1993; as well as by the rulings of the Constitutional Court: STC 3741-2004-AA-TC and STC 4293-2012-AA-TC; and by the IACHR rulings: Case of massacres of El Mozote and surrounding places vs. El Salvador, ruling of October 25, 2012; Case of expelled Dominicans and Haitians vs. Dominican Republic, ruling of August 28, 2014; Santo Domingo massacre case vs. Colombia, ruling of November 30, 2012; and Case of Norín Catrimán and others (leaders, members and activists of the Mapuche indigenous people) vs. Chile, ruling of May 29, 2014. The data obtained were organized in tables and figures for discussion with the general methods of science and particular of law; having as its main conclusion that the legal foundations of a constitutional reform for the application of diffuse administrative control are: the delimitation of justice, the legal argumentation of the Constitutional Court in the sentences, conventional law in the international community of states and a proposal of constitutional reform to apply diffuse administrative control in the Peruvian state, so the hypothesis was verified.
