| dc.description.abstract | La presente investigación tuvo como objetivo demostrar si la cláusula de allanamiento a futuro contenida en un contrato de arrendamiento, es eficaz para la restitución del bien inmueble en 15 días según lo establecido en la ley 30201 que Para llevar a cabo la investigación se analizaron los términos jurídicos contrato de arrendamiento, desalojo y cláusula de allanamiento a futuro. Asimismo, se realizó un análisis doctrinario y jurisprudencial del proceso de desalojo. Por otra parte, se extrajo información de 08 expedientes judiciales tramitados ante el Juzgado de Paz Letrado de La Corte Superior de Justicia de La Libertad. Para analizar la información se utilizaron los métodos inductivo-deductivo, hermenéutico-jurídico e histórico. Las técnicas de acopio documental, fichaje e interpretación normativa cumplieron un papel importante para llegar a obtener las conclusiones de la investigación. Finalmente, con el presente estudio se pretende contribuir a identificar soluciones que permitan brindar celeridad al proceso de desalojo, eliminando los procedimientos que entorpecen una correcta administración de justicia, pues no se rado brindar al arrendador la confianza necesaria para que ante un incumplimiento de contrato recupere su bien de manera rápida, esa desconfianza nuestro país por la escasez de viviendas. | |
| dc.description.abstract | ABSTRAC The objective of this investigation was to demonstrate whether the future search clause contained in a lease is effective for the restitution of the real estate in 15 days To carry out the investigation, the legal terms of the lease, eviction and search clause in the future were analyzed. Likewise, a doctrinal and jurisprudential analysis of the 08 judicial files processed before the Justice of the Peace Lawyer of the Superior Court of Justice of La Libertad. To analyze the information, the inductive-deductive, hermeneutic-legal and historical methods were used. The techniques of documentary collection, filing and normative interpretation played an important role in reaching the conclusions of the investigation. Finally, with the present study it is intended to contribute to identifying solutions that speed up the eviction process, eliminating the procedures that hinder a correct administration of justice, since it has not been possible to provide the landlord with the necessary confidence so that in the event of a breach of contract they can recover your good quickly, that distrust prevents the promotion of housing leases that is so necessary in our country due to the housing shortage. | |
