dc.descriptionIn the present work of investigation it is a question of arriving at an applicable remedy - sanction before the disposition of a property of the company of joint property for an alone spouse already it is the nullity; inefficiency; voidability; between others. For it, a study of the requirements will be realized, first, for the validity of any juridical business; I come second, of differentiating juridical fundamental categories to approach such problematics as invalidity; inefficiency; repeal; rescission; resolution and; rescilación or mutual dissent; third party, the diverse positions of the national jurists with regard to the topic matter of thesis; quarter, the jurisprudences issued by the Civil Rooms of the Supreme Court of Justice of the Republic on the position that has been adopted to level of cassations; I conscript, an analysis of the plenary sessions jurisdictional Distritales, Regional and National that, in spite of not being binding are limits and to generate unanimity in the place where they are realized; sixth, which is the juridical nature of the patrimonial regime of marriage and, his importance; seventh, a brief look on the compared Latin-American and European legislation and; finally, analyze which are the diverse suppositions that might give him in the topic matter of investigation. Thus with the present thesis one seeks to generate not automated uniformity, but, a juridical objective predictability where under no juridical and outside the law point of view it limits itself or damages any expectation of the actionable ones with regard to the resolution of his concrete cases.es_PE
dc.description.abstractEn el presente trabajo de investigación se trata de arribar a un remedio-sanción aplicable ante la disposición de un bien inmueble de la sociedad de gananciales por un solo cónyuge ya sea la nulidad; ineficacia; anulabilidad; entre otras. Para ello, se realizará, primero, un estudio de los requisitos de validez de todo negocio jurídico; segundo, diferenciar categorías jurídicas fundamentales para abordar tal problemática como: invalidez; ineficacia; revocación; rescisión; resolución y; rescilación o mutuo disenso; tercero, las diversas posiciones de los juristas nacionales respecto al tema materia de tesis; cuarto, las jurisprudencias emitidas por las Salas Civiles de la Corte Suprema de Justicia de la Republica sobre la posición que se ha adoptado en éstas; quinto, un análisis de los plenos jurisdiccionales Distritales, Regionales y Nacionales que, a pesar de no ser vinculantes son lineamientos y generan unanimidad en el lugar donde se realizan; sexto, cual es la naturaleza jurídica del régimen patrimonial de matrimonio y, su importancia; séptimo, una mirada breve sobre la legislación comparada latinoamericana y europea y; finalmente, analizar cuáles son los diversos supuestos que podrían darse en el tema materia de investigación. De este modo con la presente tesis se busca generar no uniformidad robotizada, sino, una predictibilidad jurídica objetiva donde bajo ningún punto de vista jurídico y extrajurídico se limite o vulnera toda expectativa de los justiciables respecto a la resolución de sus casos concretos.es_PE
