Regulación del Síndrome de Alienación Parental como causal para otorgar la tenencia y determinar su variación en nuestro ordenamiento jurídico

Abstract
El trabajo de investigación tiene como finalidad incorporar el Síndrome de Alienación
Parental en nuestro ordenamiento jurídico como causal para determinar la tenencia, así como
su variación en los procesos en los que se disputa la tenencia de un niño o adolescente.
Los jueces especializados en familia después de hacer una valoración de los informes
proporcionados por el equipo multidisciplinario deben considerar el examen psicológico
como prueba base, más aún si el psicólogo advierte la existencia del Síndrome de
Alienación Parental, entonces se otorgará la tenencia al padre que garantice el bienestar
psíquico y emocional del menor, garantizando de esta manera el interés superior del niño ;
para lo cual ha sido importante la revisión de casuística a nivel nacional como extranjera,
así como la opinión de especialistas y expertos en familia .
Es necesario que nuestro ordenamiento jurídico exista normativas que protejan el bienestar
de los menores en casos de separación o divorcio de los padres. La Incorporación del
Síndrome de Alienación Parental en nuestro ordenamiento jurídico contribuirá a proteger al
niño y adolescente frente a este tipo de procesos.
The purpose of the research work is to incorporate the Parental Alienation Syndrome into our legal system as a cause for determining possession, as well as its variation in the processes in which the possession of a child or adolescent is disputed. The judges specialized in family, after making an assessment of the reports provided by the multidisciplinary team, must consider the psychological examination as basic evidence, even more so if the psychologist notices the existence of Parental Alienation Syndrome, then custody will be granted to the father who guarantees the mental and emotional well-being of the minor, thus guaranteeing the best interests of the child; For which the review of cases at the national and foreign level, as well as the opinion of specialists and family experts, has been important. It is necessary that our legal system has regulations that protect the well-being of minors in cases of separation or divorce of parents.
