dc.descriptionThe effective recognition of the human rights at China is a problems that enforces desire and consistency as the Oriental giant's power grows. In the list of rights that includes in the Chapter Second itself of the Chinese Constitution, gathers all the generations of rights and nominally is not very different of the one that can find oneself in any other Constitution. However, the authoritative Governments like the one belonging to China, simply they govern behind Human Rights and they violate themselves conscienceless at all when to obey his objectives you receive treatment . They were to identify for it, the objectives and to examine the yielded casuistry for International Amnesty on violation of rights at China from the point of view of the instruments of human rights. The exegetic, inductive deductive method, analysis and synthesis were utilized, of historic analysis and dialectician; The techniques of analysis of contents and bibliographic. The obtained results were that China contravenes the right to life in front of death penalty, the right to integrity psycophysical in front of the torture and the right to the freedom in front of slavery and hard labor and other ones than they could not become real for spanning limitations of the article. The discussed findings were that China would be threatening the generic proclamation of the right to life; The generic prohibition of the torture and of the application of all the cruel and inhuman griefs; The express prohibition and with general character of the application of death penalty; The recognition of the right to personal defense; The explicit recognition of the right to integrity psycophysical in front of the torture; The recognition of the right of the freedom and to the recognition of the right to equalityes_ES
dc.description.abstractEl reconocimiento efectivo de los derechos humanos en China es una problemática que gana fuerza y consistencia a medida que crece el poderío del gigante oriental. En el listado de derechos que se incluye en el Capítulo Segundo de la Constitución China, recoge todas las generaciones de derechos y nominalmente no es muy diferente del que puede encontrarse en cualquier otra Constitución. Sin embargo, los gobiernos autoritarios como el de China, simplemente gobiernan a espaldas de los Derechos Humanos y los violan sin escrúpulo alguno cuando de cumplir sus objetivos se trata. Por ello, los objetivos fueron identificar y analizar la casuística reportada por Amnistía Internacional sobre violación de derechos en China desde el punto de vista de los instrumentos de derechos humanos. Se utilizó el método exegético, inductivo, análisis y síntesis, de análisis histórico y dialéctico; las técnicas de análisis de contenido y bibliográfica. Los resultados obtenidos fueron que China contraviene el derecho a la vida frente a la pena de muerte, el derecho a la integridad psicofísica frente a la tortura y el derecho a la libertad frente a la esclavitud y los trabajos forzados y otros que por limitaciones de extensión del artículo no se pudieron plasmar. Las conclusiones abordadas fueron que China estaría atentando contra la proclamación genérica del derecho a la vida; la prohibición genérica de la tortura y de la aplicación de todos las penas crueles e inhumanas; la prohibición expresa y con carácter general de la aplicación de la pena de muerte; el reconocimiento del derecho a la seguridad personal; el reconocimiento explícito del derecho a la integridad psicofísica frente a la tortura; el reconocimiento del derecho a la libertad y al reconocimiento del derecho a la igualdad.es_ES
