Abstract
El delito de omisión a la asistencia familiar tiene mayor incidencia en sectores que carecen de recursos económicos, lo que conlleva a que dicha obligación sea incumplida más aun en estas épocas. Por otro lado, es menester precisar que el Interés superior del niño es el principio fundamental y de aplicación obligatoria en estos procesos. Este principio se encuentra regulado en la Convención Sobre los Derechos de los niños y niñas, el cual hace referencia al bienestar total de los niños y niñas, otorgándole la prioridad correspondiente. Es por ello que, al condenar a prisión al deudor alimentario por incumplimiento del pago de deuda alimentaria, afecta derechos económicos del alimentista, además de ser una solución poco transcendente, ya que debemos recordar que; la pérdida de la libertad del demandado por Omisión a la Asistencia Familiar es la pérdida de la fuente de ingresos y aporte principal de la familia, principalmente del alimentista; que, aun cuando ésta no cubra todas las necesidades básicas, es un aporte que ayuda a su desarrollo. De lo cual colegimos que con la aplicación de la sanción penal no se resuelve el problema sino se crea una carga para el Estado y desprotección del alimentista
ABSTRACT The The crime of omission of family assistance has a greater incidence in sectors that lack economic resources, which leads to this obligation being unfulfilled even more in these times. On the other hand, it is necessary to specify that the Best Interest of the child is the fundamental principle and mandatory application in these processes. This principle is regulated in the Convention on the Rights of Children, which refers to the total well-being of children, granting it the corresponding priority. That is why, by sentencing the alimony debtor to prison for non-payment of alimony debt, it affects the economic rights of the alimony holder, in addition to being a little transcendent solution, since we must remember that; The loss of the defendant's freedom due to Omission of Family Assistance is the loss of the family's source of income and main contribution, mainly the alimony provider; that, even when it does not cover all basic needs, it is a contribution that helps its development. From which we conclude that the application of the criminal sanction does not solve the problem but rather creates a burden for the State and lack of protection for the obligee.
