El positivismo y pragmatismo jurídico en la formación de los estudiantes de derecho de las universidades nacionales del norte

Abstract
La presente investigación se origina por el interés de estudiar la problemática relacionada con el Positivismo y el Pragmatismo Jurídico en la formación de los estudiantes de Derecho de las universidades nacionales del norte del Perú en la última década. El objetivo general que orientó la investigación fue determinar la influencia del positivismo y el pragmatismo jurídico en la formación humanística de los estudiantes de derecho de las universidades nacionales del norte del Perú. Para la recolección de datos se utilizaron las técnicas del análisis documental, la entrevista, la encuesta y el fichaje. El análisis documental se aplicó sobre la muestra constituida por los planes de estudios de las facultades de derecho de las universidades nacionales de Trujillo, del Santa y Cajamarca, con la finalidad de obtener información respecto a los cursos que se prioriza en la formación de los estudiantes de derecho; asimismo, la entrevista se aplicó a la muestra de 10 docentes de las diversas universidades del norte del Perú para obtener información sobre como se viene formando a los estudiantes de derecho; de igual modo se aplicó una encuesta a una muestra de 40 alumnos de Posgrado de la Universidad Nacional de Trujillo con la finalidad de obtener información sobre su formación profesional; además, se recabó información teórica, aplicando el fichaje, de la doctrina y textos legislativos relacionados con el tema de estudio. Para el análisis de los datos se utilizaron los métodos análisis- síntesis e inductivo- deductivo y el método hermenéutico. Los resultados evidenciaron que en el Perú el Positivismo y el Pragmatismo Jurídico han influido negativamente en la formación humanística de los estudiantes de las facultades de derecho de las universidades nacionales del norte del Perú, en la última década.
The present research is originated by the interest of studying the problems related to Positivism and Legal Pragmatism in the training of Law students of the national universities of the north of Peru in the last decade. The general objective that guided the investigation was to determine the influence of positivism and legal pragmatism in the humanistic education of law students at the national universities of the north of Peru. For data collection, the techniques of documentary analysis, interview, survey, and signing were used. The documentary analysis was applied on the sample constituted by the curricula of the faculties of law of the national universities of Trujillo, Santa and Cajamarca, in order to obtain information regarding the courses that is prioritized in the training of the students of law; likewise, the interview was applied to the sample of 10 teachers from the different universities in the north of Peru to obtain information on how law students are being trained; A survey was also applied to a sample of 40 Postgraduate students of the National University of Trujillo in order to obtain information about their professional training; In addition, theoretical information was collected, applying the transfer, of the doctrine and legislative texts related to the subject of study. For the analysis of the data were used the methods analysis-synthesis and inductive-deductive and the hermeneutic method. The results showed that in Peru Positivism and Legal Pragmatism have negatively influenced the humanistic education of the students of the law faculties of the national universities of the north of Peru in the last decade.
