“Cambio del biotipo genético del sexo y su incidencia en la convencionalidad de los derechos a la identidad e igualdad”

Abstract
Em la presente tesis, investigo el control de convencionalidad de los derechos de identidad e igualdad en el Estado Peruano, con el propósito de conocer su incidencia sobre tales derechos, a partir del cambio del biotipo genético del sexo conforme a la Ley del Registro Civil N° 2 6 4 9 7, la cual demostró una incidencia negativa en tales derechos.
“Es una investigación de tipo aplicada, con enfoque cualitativo, ya que busca dar solución a um problema jurídico, creando un nuevo conocimiento mediante la interpretación. La recaudación de los datos, se logro a traves de las técnicas e instrumentos como la hoja de registro; asímismo, la revisión de los fallos nacionales e internacionales sobre Derechos Humanos, mediante su hoja de registo; también las entrevistas realizadas a jueces de la Corte de Trujillo, abogados constitucionalistas, con su cuadernillo de entrevista; finalmente se utilizó el fichaje bibliográfico y de resúmen para la compilación de datos teóricos. Los principales resultados, se desprenden de las entrevistas a expertos en la materia, así como el estudio de países latino-americanos, fallos emitidos por la Corte Interamericana de derechos humanos y el Tribuna Constitucional Peruano, para inferir las conclusiones, que evidenciaron la incidencia positiva del control de convencionalidad, en los derechos humanitarios garantizados en la Convención, al influir en la decisión de los Juzgadores, y agentes del Estado, de garantizar los derechos avalados en tratados o convenciones, cuando la norma interna del Estado que forma parte, los vulnera”.
“The control of conventionality and its incidence on the rights of identity and equality in the Peruvian State were investigated, based on the change of the genetic biotype of the sex in accordance with the Civil Registry Law No. 2 6 4 9 7, which negatively affects such rights. Regarding the collection of data, documentary collection techniques were manipulated for the review of the research variables, with its registration sheet instrument (case analysis file); likewise, the review of international judgments on Human Rights, through its record sheet (case analysis sheet-comparative law); also the interviews conducted with judges of the Court of Trujillo, constitutional lawyers, with their interview booklet (interview form); Finally, the signing was used, through bibliographic and summary records for the compilation of theoretical data. The results were evidenced in tables, to elaborate the data discussion, the analysis methods were used - synthesis, deductive and hermeneutic, later the conclusions were inferred, which evidenced the positive incidence of the control of conventionality, in the guaranteed humanitarian rights in the Convention, by influencing the decision of the Judges, and State agents, to guarantee the rights endorsed in treaties or conventions, when the internal norm of the State that they are part of, violates them”.
