Abstract
El arbitraje es una manera de solucionar controversias, sin la necesidad de acudir al fuero judicial; entre los tipos de arbitraje que existen, encontramos al Arbitraje Institucional, las partes encomiendan a los Centros de Arbitraje la solución de diversas controversias, sean estas de tipo comercial, privado, o inclusive en el marco de la contrataciones del estado. En el presente trabajo abordaremos la vulneración del principio de transparencia del arbitraje institucional en el marco de las contrataciones con el estado, este punto es de crucial importancia para lograr una reformulación positiva del arbitraje institucional en el marco de las contrataciones del estado, teniendo en cuenta que estas controversias son de Interés Público. Creemos que, todo extremo es malo, en el arbitraje institucional en el marco de las contrataciones del estado se debe respetar el principio de transparencia, enmarcado en justos y necesarios términos sin sobrepasar este límite.
