Análisis de las grabaciones subrepticias por uno de los interlocutores como supuesto de prueba prohibida por violentar derechos fundamentales

| dc.description.abstract | Se analiza y define si las grabaciones subrepticias que realiza uno de los interlocutores de la comunicación sin el conocimiento y, por ende, consentimiento de su contraparte, constituye prueba ilícita de forma tal que, desde el ámbito de la legalidad, deba negársele eficacia probatoria en el contexto del proceso. Para ello, se analiza la categoría de prueba ilícita en el marco del derecho a la prueba y el carácter garantista del proceso mediante un análisis doctrinal nacional e internacional y jurisprudencia nacional. Luego, para determinar el carácter ilícito o no de este tipo de rabaciones, esto es, si lesiona el núcleo esencial de los derechos fundamentales a la inviolabilidad de las comunicaciones e intimidad; para ello, se realiza un análisis del ámbito protegido por estos derechos, en donde se verificará la imprecisión y confusión en que la jurisprudencia nacional incurre al momento de definir qué aspecto concreto de la dignidad humana es protegida por cada uno de estos derechos y como finalmente estos ámbitos se yuxtaponen indebidamente. Finalmente, se logrará establecer la ausencia de lesión de estos derechos por esta forma de grabaciones, y la posibilidad de su utilización probatoria en todo proceso. | |
| dc.description.abstract | ABSTRACT This undergraduate research analyzes and defines whether the surreptitious recordings made by one of the interlocutors of the communication without the knowledge and, therefore, consent of his counterpart, constitute unlawful evidence in such a way that, from the scope of legality, it should be denied evidentiary effectiveness in the context of the process. For this purpose, the category of unlawful evidence is analyzed within the framework of the right to evidence and the guaranteeing nature of the process through an analysis of national and international doctrine and national jurisprudence. Then, to determine the illicit character or not of this type of recordings, that is, if it harms the essential nucleus of the fundamental rights to inviolability of communications and privacy; for this purpose, an analysis of the scope protected by these rights is made, where the imprecision and confusion in which the national jurisprudence incurs at the time of defining what specific aspect of human dignity is protected by each of these rights and how finally these areas are juxtaposed unduly will be verified. Finally, it will be possible to establish the absence of injury to these rights by this form of recordings, and the possibility of their evidentiary use in any process. | |
