| dc.description | On the fifth of June two thousand and seven approved Law 29032, Law mandating the issuance of a new game or birth certificate when the acknowledgment of paternity or maternity is performed after the date of registration, in order to eliminate violations of the right to privacy of the owners of these items or records birth-and in them the nature of the affiliation of the sons are consigned; however, with the promulgation of this rule in a different way and discriminator was generated people also hold these items or birth certificates but were recognized before the date of the enactment of this rule, those who do not benefit from this provision are and therefore their records or birth certificates are consigning their origin extramarital mainly vulnerándoles their right to equal forgetting that all children have equal rights and that any mention of the civil status of the parents is constitutionally prohibited and the nature filiation in civil registers and any other identification. | dc.description.abstract | El cinco de junio del año dos mil siete se aprobó la Ley N° 29032, Ley que ordena la expedición de una nueva partida o acta de nacimiento cuando el reconocimiento de paternidad o maternidad se realiza con posterioridad a la fecha de inscripción - ya que en ella se consignaba la naturaleza de la filiación de los hijos- a fin de eliminar la vulneración del derecho a la intimidad de los titulares de esas partidas o actas de nacimiento; sin embargo con la promulgación de esta norma se generó un trato diferente y discriminador a las personas también titulares de estas partidas pero que fueron reconocidas con fecha anterior a la vigencia de esta norma, quienes no se encuentran beneficiados de esta disposición y por lo tanto sus actas o partidas de nacimiento siguen consignando su origen extramatrimonial, vulnerándoles principalmente su derecho a la igualdad olvidando que todos los hijos tienen iguales derechos y que se encuentra constitucionalmente prohibida toda mención sobre el estado civil de los padres y sobre la naturaleza de la filiación en los registros civiles y en cualquier otro documento de identidad. En esta investigación nos encargamos en una primera parte de precisar los fundamentos jurídicos y doctrinarios que respaldan nuestra hipótesis; luego analizaremos la posición de la Defensoría del Pueblo y del Reniec en torno a este caso, para concluir definiendo nuestra posición basados en los argumentos descritos | es_PE |
