Abstract
La característica principal de una relación laboral es la subordinación a raíz del cual el empleador ejerce el poder de dirección dirigiendo, supervisando o sancionando. Sin embargo, estas facultades no son absolutas, sino que tienen un límite como el derecho a la dignidad del trabajador, a la salud e integridad, de tal manera que el empleador puede ejercer el poder de dirección, pero dentro de los límites que establece los derechos antes mencionados. A raíz de la pandemia de Covid-19, el teletrabajo se ha convertido en una modalidad de trabajo que ha permitido continuar con las actividades económicas, pero con muchas deficiencias en cuanto a su aplicación, debido a la falta de regulación que desarrolle el derecho a la desconexión digital como un mecanismo para garantizar la salud e integridad del trabajador. Este vacío legal, permitió que los empleaores realicen un ejercicio abusivo del poder de dirección a tal punto de dictar disposiciones a cualquier hora del día e incluso fines de semana, vulnerando la jornada máxima laboral y el horario laboral establecido, por lo cual resulta necesario una exhaustiva investigación al respecto, que permita establecer criterios hacia una regulación del derecho a la desconexión digital y su aplicación.
ABSTRACT The main characteristic of an employment relationship is the subordination as a result of which the employer exercises the power of direction directing, supervising or sanctioning. However, these powers are not absolute, but have a limit such as the right to dignity of the worker, to health and integrity, in such a way that the employer can exercise the power of direction, but within the limits established by the aforementioned rights. As a root of the Covid-19 pandemic, teleworking has become a work modality that has allowed economic activities to continue, but with many deficiencies in terms of its application, due to the lack of regulation that develops the right to digital disconnection as a mechanism to guarantee the health and integrity of the worker. This legal vacuum allowed employers to carry out an abusive exercise of management power to the point of dictating provisions at any time of the day and even on weekends, violating the maximum working day and the established working hours, for which it is necessary a exhaustive investigation in this regard, which allows establishing criteria towards a regulation of the right to digital disconnection and its application.
