dc.descriptionThe present denominated investigation “the Extrajudicial Transaction as Half of Extinction of the Obligations of the Andean High Settler in the North Zone of Peru” it must like primary target especially demonstrate that in spite of not to be well-known the transaction like legal institution by the Peruvian settlers in the Andean zones high of Peru. Nevertheless it is applied like an alternative mechanism of conflict resolution, essentially of patrimonial nature. In order to resist the formulated hypothesis and to fulfill the objectives of the investigation, it had like source that gives sustenance to the Thesis, the analysis of the doctrine on the transaction and the applicable legal norms in soothes national and right compared. A survey model was structured that was applied - previous selection - in centers populated with the Regions of Cajamarca and the Freedom (Chilacat, Namora, Otuzco, Salpo and Usquil respectively). The obtained results demonstrate that the settlers of the Andean zones high of Peru prefer to directly solve their problems sustained in the Good Faith, applying extrajudicial transactions, but without the rigor of the Legal formalisms, obtaining extinction of the obligations, which denotes the distrust in the formal systems of justice of our State.es_ES
dc.description.abstractLa presente investigación denominada “La Transacción Extrajudicial como Medio de Extinción de las Obligaciones del Poblador Alto Andino en la Zona Norte del Perú” tiene como objetivo principal demostrar que pese a no ser conocida la transacción como institución jurídica por los pobladores peruanos especialmente en las zonas alto andinas del Perú. Sin embargo es aplicada como un mecanismo alternativo de solución de conflictos, fundamentalmente de índole patrimonial. Para contrastar la hipótesis formulada y cumplir los objetivos de la investigación, se tuvo como fuente que da sustento a la Tesis, el análisis de la doctrina sobre la transacción y de las normas jurídicas aplicables en sede nacional y derecho comparado. Se estructuró un modelo de encuesta que se aplicó – previa selección – en centros poblados de la Regiones de Cajamarca y la Libertad (Chilacat, Namora, Otuzco, Salpo y Usquil respectivamente). Los resultados obtenidos demuestran que los pobladores de la zonas alto andinas del Perú prefieren resolver directamente sus problemas sustentada en la Buena Fe, aplicando transacciones extrajudiciales , pero sin el rigor de los formalismos Jurídicos, logrando extinción de las obligaciones, lo que denota la desconfianza en los sistemas de justicia formales de nuestro Estado.es_ES
