dc.descriptionThe Research Institute of the Administrative Procedural: The silence, which emerge as a result of procedural inactivity on the part of public administration, compared to a request, application, appeal, and so on., It is obliged to respond within the deadline set in the law, leads us to argue that their regulation, through a Special Law No. 29,060 and amending D. Leg. No. 1029, falls within the process of globalization and internationalization of the economy, seeking to revitalize the national economy as well as the efficiency and transparency of management and public service. We note that in our legal system - administration, the silence in Peru has been an evolutionary process: He joined the Silence Negative, then passes the silence and ultimately favors silence, without denying the Silence Negative, through the Special Law No. 29,060 and amending D. Leg. No. 1029. The theoretical structure of the thesis, aims to sustain the importance of a special law regulating the silence, as not only the Institute Procedural rules, but in the case of Peru, the Special Law, has established, now, a set of new, or new functions to existing administrative bodies, or, has set new strategies in order to make viable the silence Positive punishing negligence, officials and public employeeses_PE
dc.description.abstractLa presente Investigación, sobre el Instituto Procedimental Administrativo: El Silencio Administrativo, que emerge como consecuencia de la inactividad procedimental, en que incurre la administración pública, frente a una petición, solicitud, recurso, etc., a que está obligado a responder, dentro del plazo establecido en la Ley, nos lleva a sostener, que su regulación, a través de una Ley Especial Nº 29060 y su modificatoria D. Leg. Nº 1029, se inscribe, dentro del proceso de globalización e internacionalización de la economía, de la búsqueda de la dinamización de la economía nacional, así como de la eficiencia y transparencia de la gestión y función pública. Señalamos, que en nuestro ordenamiento jurídico – administrativo, el Silencio Administrativo en el Perú, ha tenido un proceso evolutivo: Se incorpora con el Silencio Negativo, posteriormente se pasa el Silencio Positivo y últimamente se privilegia el Silencio Positivo, sin negar el Silencio Negativo, a través de la Ley Especial Nº 29060 y su modificatoria D. Leg. Nº 1029. La estructura teórica de la Tesis, se encamina a sostener, la importancia de que una Ley Especial, regule el Silencio Administrativo, en cuanto, no solamente norma este Instituto Procedimental, sino que, en el caso peruano, la Ley Especial, ha establecido, ora, un conjunto de nuevos órganos, ora, nuevas atribuciones a órganos administrativos ya existentes, ora, ha establecido nuevas estrategias, con el fin de hacer viable el Silencio Administrativo Positivo, sancionando la negligencia, de los funcionarios y empleados públicoses_PE
