| dc.description | Social security is a mechanism of protection of the human being in the face of contingencies that occur during his life and that generate a decrease in his work capacity, this is intended to raise or at least maintain his social economic level from that decrease ; it is in this sense that the present investigation will be developed in order to determine how the Direct Transfer of the fisherman disposed in Law 30003, affects the Right to Social Security of its beneficiaries, in the end that in not establishing the norm is a minimum pension, it is giving rise to the fact that in many cases the beneficiaries of the TDEP receive a pension whose amounts are well below that of a regular pension, thus affecting their constitutional right to receive a minimum pension vital. | dc.description.abstract | La seguridad social es un mecanismo de protección del ser humano ante las contingencias que se producen durante su vida y que generan una disminución en su capacidad laboral, ello tiene por finalidad elevar, o cuando menos mantener, su nivel económico social a partir de dicha disminución; es en este sentido que se va a desarrollar la presente investigación a fin de determinar de qué manera la Transferencia Directa del Ex pescador dispuesta en la Ley 30003, afecta el Derecho a la Seguridad Social de sus beneficiarios, en el extremo de que al no establecer la norma una pensión mínimo tope, se está dando pie a que en muchos casos los beneficiarios de la TDEP perciban una pensión cuyos montos se encuentran muy por debajo del de una pensión previsional regular, afectando de este modo su derecho constitucional a recibir una pensión mínima vital. En este sentido, que tras haber realizado las investigaciones necesarias, valiéndonos de fuentes bibliográficas, legislación vigente, fuentes jurisprudenciales; así como teniendo en cuenta los resultados de la entrevista realizada a agentes directos de la Oficina de Normalización Previsional, como ente que a la fecha ha monopolizado el Sistema Previsional Estatal, es que podemos concluir que al no existir una normativa que regule o fije una pensión mínima tope es que la transferencia directa del Ex pescador dispuesta en la Ley 30003, afecta el Derecho a la Seguridad Social de sus beneficiarios, al vulnerar su derecho a gozar de una pensión previsional mínima, afectando así una de las tres dimensiones básicas que conforman el Derecho a la Seguridad Social | es_PE |
