Abstract
La presente tesis se orienta a buscar y precisar, cual es el nuevo rol, del sindicato y sindicalismo peruano, en un nuevo escenario, signado por el desarrollo exponencial de la ciencia y la tecnología de la globalización, de la robotización, del predominio de nuevos paradigmas, en el quehacer sindical, que está exigiendo al sindicalismo público y a sus dirigentes una reformulación de sus objetivos y fines en este nuevo escenario mundial y nacional, que se traduce ya no solo en defensa de los agremiados sino en participar en un dialogo creativo, con el Estado y la empresa, en la formulación de un esquema societal, más justo, promoviendo la defensa de los Derechos Humanos, no solo de sus agremiados, sino de todos los Ciudadanos del país. De igual manera desarrolla un análisis crítico al Decreto de Urgencia Nº 014 – 2020, que ha modificado la normatividad sobre Negociación Colectiva, prevista en la Ley Servir Nº 30057 y en su Reglamento.
ABSTRAC This thesis is oriented, to find and specify, what is the new role, of the Peruvian union and syndicalism, in a new scenario, marked by the exponential development of the science and technology of globalization, robotization, the predominance of new paradigms, in union work, which is demanding that public unionism and its leaders reformulate their objectives and goals in this new world and national scenario, which is translated not only in defense of union members but in participating in creative dialogue , with the State and the company, in the formulation of a fairer societal scheme, promoting the defense of Human Rights, not only of its members, but of all the Citizens of the country. Likewise, it develops a critical analysis of the Emergency Decree No. 014-2020, which has modified the regulations on Collective Bargaining, provided for in the Serve Law No. 30057 and its Regulations.
