dc.descriptionIn the process of developing this thesis we challenge ourselves to innovate in research work that contributes to the bibliography of our flagship Faculty of Law, addressing an issue that is currently of collective interest but whose effects yet they have been able to counter effectively. Therefore it should be noted that the damage to the environment as a result of pollution generated by mining companies in Peru and in the world have reached alarming levels. These, in many cases by the spill of mine tailings and other products used during the extraction and processing of mineral, causing the loss of biodiversity, the imbalance of ecosystems and threaten human health; it also involves the violation of a constitutionally protected right that not only hurts one person but to an indeterminate, what the doctrine called pure environmental damage. Different branches of law have tried to solve this problem without success. However, we find the solution in a special mechanism, which will compensate for the effects of environmental damage immediately and effectively, we refer to the creation of an environmental insurance covering tort liability on environmental damage caused by companies contaminants. So, what we said is that there is a mechanism of immediate solution to the environmental damage occurred, preventing further deterioration of the affected pending the outcome of long-term processes in time; thus creating an environmental insurance that can take the disastrous effects that companies produce would be needed.es_ES
dc.description.abstractEn el proceso de desarrollo de la presente tesis nos planteamos el reto de innovar en un trabajo de investigación, que contribuya con el acervo bibliográfico de nuestra emblemática Facultad de Derecho, abordando un tema que en la actualidad es de interés colectivo pero cuyos efectos aún no se han podido contrarrestar eficazmente. Por ello es preciso señalar que los daños producidos en el medio ambiente como consecuencia de la contaminación generada por las empresas mineras en el Perú y en el mundo han alcanzado niveles alarmantes. En muchos casos por el derrame de relaves mineros y otros productos usados durante el proceso de extracción y procesamiento del mineral, causan la pérdida de la biodiversidad, el desequilibrio de los ecosistemas y atentan contra la salud humana; ello también implica la vulneración de un derecho constitucionalmente protegido que no sólo perjudica a una persona, sino a una colectividad indeterminada, lo que la doctrina le denomina daño ambiental puro1. Diferentes ramas del derecho han tratado de resolver este problema sin éxito. No obstante, creemos encontrar la solución en un mecanismo especial, que permitirá resarcir los efectos del daño ambiental producido de manera inmediata y efectiva, nos referimos a la creación de un seguro ambiental que cubra la responsabilidad civil extracontractual sobre los daños medioambientales producidos por las empresas contaminantes.es_ES
