dc.description.abstractLa presente investigación buscó determinar si la tipificación del delito de feminicidio contraviene el derecho constitucional de igualdad ante la ley. Con tal fin se describió la naturaleza constitucional del derecho a la igualdad ante la ley, se identificó los fundamentos jurídicos del incremento de punibilidad y se analizó los fundamentos jurídicos del delito de feminicidio. En la investigación se desarrolló teóricamente el principio de igualdad ante la ley, los fundamentos del delito de feminicidio y la tipología del delito de feminicidio. La investigación fue de tipo básica, cualitativa, las técnicas utilizadas fueron el fichaje y la encuesta, y los instrumentos fueron la ficha y el cuestionario.
dc.description.abstractABSTRACT The present investigation intends to determine if the definition of the crime of femicide contravenes the constitutional right of equality before the law. To this end, the constitutional nature of the right to equality before the law was described, the legal foundations of the increase in punishability were identified, and the legal foundations of the crime of feminicide were analyzed. In the investigation, the principle of equality before the law, the foundations of the crime of femicide and the typology of the crime of femicide were theoretically developed. The research was of a basic, qualitative type, the techniques used were the recording and the interview, and the instruments were the file and the questionnaire.
