dc.descriptionThis thesis develops the main aspects of the Land Transportation of People as a Public Service since 2018. In the first and second chapters, the author will develop the general notions about the role of the State in the economy, specifying the changes that occurred in its own organization with the emergence of different services to be guaranteed, along with its impact on the dynamic need to link with the citizen, i.e., the transition from State - Power to State - Service State. In a third chapter, the author elaborates on the idea of land transportation as a concept, from its historical notion, to its evolution and variation, taking into account the importation of legal notions from abroad and the analysis model to qualify an activity as a Public Service; all this, according to the understanding of the Peruvian Constitutional Court (Exp. 034-2004-PI/TC). Finally, as the last chapter, the author will include the Urban Transportation Authority for Lima and Callao, as a form of administrative linkage, according to his model, between the State and Society, within the framework of Law Nro. 30900, with which, all the previous chapters are intercepted to allow the reader to reach the conclusions raised in the heart of this work.es_PE
dc.description.abstractLa presente tesis desarrolla los aspectos principales del Transporte Terrestre de Personas como Servicio Público desde el año 2018. En el primer y segundo capítulo, el autor desarrollará las nociones generales acerca del rol que cumple el Estado en la economía, precisándose los cambios que hubo en su propia organización con la aparición de distintos servicios a ser garantizados, junto con su impacto en la necesidad dinámica de vincularse con el ciudadano, vale decir, el paso de Estado – Poder a Estado restacional. En un tercer capítulo, el autor abunda sobre la idea del transporte terrestre como concepto, desde su noción histórica, hasta su evolución y variación, tomando en cuenta la importación de nociones jurídicas del extranjero y el modelo de análisis para calificar una actividad como Servicio Público; todo esto, de acuerdo a la comprensión del Tribunal Constitucional Peruano (Exp. 034-2004-PI/TC). Finalmente, como último capítulo, el autor incluirá a la Autoridad de Transporte Urbano para Lima y Callao, como forma de vinculación administrativa, de acuerdo a su modelo, entre el Estado y Sociedad, en el marco de la Ley NRO. 30900, con lo cual, se interceptan todos los capítulos previos para permitir al lector llegar a las conclusiones planteadas en el corazón del presente trabajo.es_PE
