However, with the entry into force of Legislative Decree No. 1384, new changes were established on the way in which people with intellectual or psychosocial disabilities begin to be treated by establishing that they have full capacity to exercise their rights. In this sense, we will study the procedure for the granting of the orphan's pension for persons with intellectual or psychosocial disabilities, starting from the requirements of the TUPA of the ONP before and after the enactment of Legislative Decree 1384; We will also analyze how the Office of Social Security Normalization (ONP) has been acting with respect to the procedure for obtaining an orphan's pension, and in its absence we will proceed to make a proposal in the TUPA in order to bring it into line with the new perspective established in Legislative Decree 1384. dc.description.abstractLas personas con discapacidad intelectual y psicosocial han sido objeto de discriminación social y exclusión, siendo percibidas como incapaces de tomar sus propias decisiones, hasta el propio Estado, con un fin “proteccionista”, amparan en su legislación figuras que restringe su voluntad y autonomía, como el proceso de interdicción y la representación mediante curatela. Ahora bien, con la entrada en vigencia del D.L N°1384 se establecieron nuevos cambios sobre la forma como se empieza a tratar a las personas con discapacidad intelectual o psicosocial al establecer que tienen plena capacidad para el ejercicio de sus derechos. En este sentido, nos avocamos al estudio del trámite para el otorgamiento de la pensión de orfandad para personas con discapacidad intelectual o psicosocial, partiendo de los requisitos que exige el TUPA de la ONP antes y después de la vigencia del Decreto Legislativo 1384; asimismo analizaremos como ha venido actuando la Oficina de Normalización Previsional (ONP) respecto al procedimiento del trámite de obtención de una pensión de orfandad, y en su defecto procederemos a brindar una propuesta en el TUPA a fin de que sea acorde a la nueva perspectiva establecida en el D.L. N°1384.es_PE
