dc.descriptionABSTRACT The research aimed to determine how to achieve the effectiveness of the socio-educational internment measures regulated in the Code of Children and Adolescents of Peru. For the verification of the hypothesis, the information was obtained from a study sample consisting of 05 relevant sentences on the socioeducational measures imposed on juvenile offenders in the 2009-2017 period of the Superior Court of Justice of La Libertad; of statistical reports on juvenile offenders; the legislation that regulates juvenile criminal justice and its amendments; as well as the 06 family judges of Trujillo; For this, the techniques of documentary analysis and the interview for the personal sample were applied, whose results were presented in tables and figures of statistical frequency. For the discussion of the results, the analysis, synthesis, inductive, deductive, historical and hermeneutical methods were used. It was concluded that: if a minimum period is established for the application of the measures of internment, age range of the juvenile offenders in accordance with the offenses to the criminal law committed, with the purpose of reeducation and reintegration of the minor offender, and executing a Individual Plan analyzing the psychosocial characteristics of each offending adolescent, the effectiveness of the socioeducational internment measures imposed on the offending adolescents in the Code of Children and Adolescents in Peru will be achieved. What allowed to verify the hypothesis and to propose a normative proposal for a more effective juvenile justice.es_PE
dc.description.abstractRESUMEN La investigación tuvo como objetivo determinar cómo lograr la eficacia de las medidas socio-educativas de internación reguladas en el Código de los Niños y Adolescentes del Perú. Para la verificación de la hipótesis, se procedió a la obtención de la información de una muestra de estudio conformada por 05 sentencias relevantes sobre las medida socioeducativa impuesta a los menores infractores en el periodo 2009-2017 de la Corte Superior de Justicia de La Libertad; de los informes estadísticos sobre los menores infractores; la legislación que regula la justicia penal juvenil y sus modificatorias; así como por los 06 jueces de familia de Trujillo; para ello se aplicaron las técnicas del análisis documental y la entrevista para la muestra personal, cuyos resultados se presentaron en tablas y figuras de frecuencia estadística. Para la discusión de los resultados se utilizaron los métodos análisis, síntesis, inductivo, deductivo, histórico y hermenéutico. Se concluyó que: si se establece un período mínimo para la aplicación de las medidas de internamiento, rango de edades de los menores infractores acorde con las infracciones a la ley penal cometidas, teniendo como fin la reeducación y reinserción del menor infractor, y ejecutando un Plan Individual analizando las características psicosociales de cada adolescente infractor, se logrará la eficacia de las medidas socioeducativas de internación impuestas a los adolescentes infractores en el Código de los Niños y Adolescentes en el Perú. Lo que permitió verificar la hipótesis y plantear una propuesta normativa para una justicia juvenil más eficaz.es_PE
