dc.descriptionABSTRACT The present investigation has been in charge of investigating the assembled families and the legal and social foundations that sustain the alimentary obligation of related children by the social parents, due to the legal vacuum existing in our legal system and the lack of pronouncement by our doctrine, since it has only been recognized by our Constitutional Court in some of its judgments. For this, it was necessary to collect data and analysis of doctrine, sentences and regulation in Comparative Law, where in countries such as Switzerland, Argentina and Uruguay the figure of families assembled in their laws has already been incorporated. to the different duties and obligations existing in this new family structure, being one of them, the alimentary duty on the part of the social parents in favor of their related children. In that sense, it was possible to determine that the assembled families have been evolving since remote times and it is a social reality of which our legislation is alien, for which its regulation is necessary where the best interest of the child prevails and is not left helpless in This new family will be a participant, since children are the most affected to this type of change.es_PE
dc.description.abstractRESUMEN La presente investigación se ha encargado de investigar a las familias ensambladas y los fundamentos jurídicos y sociales que sustentan la obligación alimentaria de los hijos afines por parte de los padres sociales, debido al vacío legal existente en nuestro ordenamiento jurídico y la falta de pronunciamiento por nuestra doctrina, ya que solamente ha sido reconocida por nuestro Tribunal Constitucional en algunas de sus sentencias. Para ello, fue necesario la recopilación de datos y análisis de la doctrina, sentencias y regulación en el Derecho Comparado, donde en países como Suiza, Argentina y Uruguay ya ha sido incorporada la figura de familias ensambladas en sus legislaciones, las cuales regulan los distintos deberes y obligaciones existentes en esta nueva estructura familiar, siendo uno de ellos, el deber alimentario por parte de los padres sociales a favor de sus hijos afines, bajo los principios de igualdad, afectividad, solidaridad y la convivencia pública. En ese sentido, se pudo determinar que las familias ensambladas han ido evolucionando desde tiempos remotos y es una realidad social de la cual nuestra legislación es ajena, por lo que es necesaria su regulación donde prime el interés superior del niño y no se vea desamparado en esta nueva familia a la cual será partícipe, ya que son los niños los más perjudicados a este tipo de cambio.es_PE
