| dc.description | This Thesis for the title of lawyer aims to develop the theme of due process and its implementation within the administrative sanctioning procedure. For this purpose it is noted that the right to punish the State is not only expressed in the executive branch, through the sanctioning administrative law, the judiciary, through the penal code, also expressed through the legislature, when researching and it penalizes states that the latter sanctioning power, is political in nature and is expressed through political judgment and political impeachment, and is essentially political naturalizes to high state officials covered by Art. 99 of the constitution of '93 unlike the sanctioning power of the executive branch, which is legal-administrative, and judiciary of legal and criminal naturalizes. The thesis also requires innovations on Sanctions Regime and Procedure Sanctioning brings the Law 30057: Civil Service and finally from the dogmatic Due Process Try these conceptual guidelines in due procedure in which should be developed sanctioning powers of public administration. | dc.description.abstract | La presente Tesis para optar el Título de abogado se orienta a desarrollar la temática del debido proceso y su aplicación, dentro del procedimiento sancionador Administrativo. Para tal efecto se señala que el IUS PUNIENDI del Estado no solo se expresa en el poder ejecutivo, a través del Derecho administrativo sancionador, del poder judicial, a través del código penal, también se expresa a través del poder legislativo, cuando se investiga y sanciona a los altos funcionarios del estado comprendidos en el Art. 99 de la constitución del 93. Se precisa que esta última potestad sancionadora, es de naturaleza política y se expresa a través del Juicio político y el antejuicio político, y es de naturaliza esencialmente política, a diferencia de la potestad sancionadora del poder ejecutivo, que es jurídico-administrativo, y del poder judicial de naturaliza jurídico-penal. La tesis también precisa las innovaciones que sobre el Régimen de Sanciones y Procedimiento Sancionador trae la Ley 30057: del Servicio Civil y por ultimo a partir de la dogmática del Debido Proceso Trata de aplicar estas orientaciones conceptuales en el debido procedimiento que en el que debe desarrollarse la potestad sancionadora de la administración Publica.
