dc.description.abstractLa gestación subrogada es una técnica de reproducción humana asistida que causa mucha controversia; sin embargo, es la solución para muchos que desean concebir un hijo y no pueden hacerlo fisiológicamente. En la presente investigación planteamos como objetivo determinar si la legitimidad convencional de la gestación subrogada en resguardo del derecho a la procreación incide en la determinación jurisdiccional de la filiación socioafectiva como expresión del derecho a la identidad dinámica en respeto del interés superior del menor.La importancia de un estudio analítico de la problemática en torno a esta técnica permite determinar la filiación del menor a favor de quien manifestó su voluntad procreacional y su proyección en un ambiente que optimice el interés superior del concebido. El derecho es evolutivo y el Perú no ha sido ajeno a las tecnologías en materia de biomedicina, por tanto, debe reconocerse la legitimidad de estas técnicas a raíz de la doctrina convencional que dicta el Derecho Internacional de Derechos Humanos.El informe es novedoso porque, desde un enfoque constitucional convencionalizado, se anal izan los criterios predominantes en los procesos judiciales nacionales a efecto del reconocimiento de la filiación del menor con los padres intencionales en el marco de la gestación subrogada.
dc.description.abstractABSTRACT Surrogacy is an assisted human reproduction technique that has generated much controversy at the national and international level; however, it is the solution for many people who want to conceive a child and cannot do so physiologically. In the present research work we propose as main objective to determine if the conventional legitimacy of Surrogacy in protection of the right to procreation affects the preponderant jurisdictional determination of socio-affective affiliation as an expression of the right to dynamic identity in respect of the best interests of the minor. The importance of an analytical and rigorous study of the problems around Surrogacy allows to duly determine the affiliation of the minor in favor of the one who expressed his procreational will and the projection of it in an environment that optimizes the best interests of the conceived. The law is evolving and Peru has not been oblivious to new technologies in biomedicine, therefore, the legitimacy of Assisted Human Reproduction Techniques must be recognized as a result of the conventional doctrine dictated by International Human Rights Law. This thesis report is novel because, from a conventionalized constitutional approach, the predominant criteria in national judicial processes are analyzed for the purpose of recognizing the minor's affiliation with the intended parents in the framework of Surrogacy.
