Abstract
Homosexuality and homosexual couples come under discussion for academics, theorists and legislators of the world. Currently there are two positions on the one hand those who agree to grant fundamental and social rights to homoafectivas couples and who does not. To get a suitable position of the subject we have studied different existing evidence of homosexual people since ancient times. Larger cultures of the ancient world characterized under a veil of mystique and religiosity, however some cultures changed position according to those in power restricting and punishing homoerotic practices. In Peru homosexuality has been known in the pre-Inca cultures. The Moche and Vicus cultures give example through their ceramic figurines and where you can see the male homoerotic practices among its inhabitants. Nowadays, homosexuality is not a favorable category of protection , even more over the years legislative pretensions to regulate and promote the gay community have been dismissed , many of them because of the stigma and discrimination that accentuated in conservative groups like the church . The Family as the natural and historical institution of mankind has not been easy to describe. To this day the concept of family has the characteristic variability , which is why many authors consider that it is not recommended the definition of family in the law of a country, because this is changeable according to the evolution of society. Under optimum found that different kinds of families, the most important regulated by the Peruvian legal system, however is the Homoafectiva Family which is totally helpless in Peru. At the International level, our country is considered as one of the most conservative to not regulate social situation of homosexuals, including denying them their unions protection and quality of family even though their relationships have all the features that heterosexual unions. Unlike what we live in Peru, other countries set the family to recognize as homoafectivas pairs is consistent with fundamental rights regulated by various international law instruments and more with the General Principles of Family Law, through which the maxim " family Protection " means any state should ensure that all types of families without distinction this legally regulated and protected.

La homosexualidad y las parejas homosexuales vienen siendo objeto de debate para académicos, teóricos y legisladores del mundo. Actualmente existen dos posturas, por un lado quienes coinciden otorgar los derechos fundamentales y sociales a las parejas homoafectivas y quiénes no. Para tener una posición adecuada del tema hemos estudiado las distintas evidencias que existen de las personas homosexuales desde tiempos remotos. Las más grandes culturas del mundo antiguo la caracterizaban bajo un velo de misticidad y religiosidad, sin embargo algunas culturas cambiaban de posición de acuerdo a los gobernantes de turno restringiendo y sancionando a las prácticas homoeróticas. En el Perú la homosexualidad ha sido conocida en las culturas preincas. Las culturas Moches y Vicus dan ejemplo de ello a través de sus cerámicos y huacos donde se puede apreciar las practicas homoeróticas masculinas entre sus habitantes. En nuestros días, la homosexualidad no es una categoría favorable de protección, más aun a lo largo de los últimos años las pretensiones legislativas que intentan regular y favorecer a la comunidad homosexual han sido desestimadas, muchas de ellas por causa del estigma y discriminación que se acentúa en grupos conservadores como la iglesia. La familia como institución natural e histórica de la humanidad, no ha sido fácil de describir. Hasta nuestros días la concepción de familia tiene como característica su variabilidad, es por ello que numerosos autores consideran que no es recomendable definir a la familia en la legislación de un país, debido a que esta es cambiante de acuerdo a la evolución de la sociedad. Bajo esa optima encontramos distintas clases de familias, las más importantes reguladas por el Ordenamiento Jurídico Peruano, empero es la familia homoafectiva la cual está totalmente desamparada en el Perú.
