Abstract
Este estudio tiene el propósito de dilucidar la problemática de la potestad sancionadora disciplinaria que ejercen las Unidades de Gestión Educativa Locales de Trujillo en el año 2019 en orrelación con la garantía constitucional debida motivación en las resoluciones de sanción administrativas en los procesos administrativos disciplinarios para docentes. Es así, que se ha podido obtener como resultado que los principios de la debida motivación, el debido procedimiento administrativo y la presunción de inocencia son los derechos fundamentales más vulnerados en los procesos administrativos disciplinarios para docentes en Trujillo en el año 2019. Asimismo, se evidencia la falta de diligencia, rigurosidad y arbitrariedad de parte de las Comisiones Permanentes de Procesos Administrativos Disciplinarios para docentes en materia de investigación y análisis de medios probatorios que sustenten las sanciones administrativas disciplinarias impuestas a las docentes procesadas.
ABSTRACT The purpose of this research work is to elucidate the problem of the disciplinary sanctioning power exercised by the Local Educational Management Units of Trujillo in 2019 in correlation with the constitutional guarantee of due motivation in the administrative sanction resolutions in the administrative disciplinary processes for teachers. Thus, it has been possible to obtain as a result that the principles of due motivation, due administrative procedure and the presumption of innocence are the most violated fundamental rights in administrative disciplinary processes for teachers in Trujillo in 2019. Likewise, the lack of diligence, thoroughness and arbitrariness on the part of the Permanent Commissions of Administrative Disciplinary Processes for teachers in terms of investigation and analysis of evidentiary means that support the administrative disciplinary sanctions imposed on the teachers prosecuted is also evident.
