Efecto jurídico de la intervención del Derecho Penal en delitos leves por violencia familiar en el distrito de Santa 2018 - 2019

Abstract
El presente trabajo de investigación titulado “EFECTO JURÍDICO DE LA INTERVENCIÓN DEL DERECHO PENAL EN DELITOS LEVES POR VIOLENCIA FAMILIAR EN EL DISTRITO DE SANTA 2018 – 2019” trata una problemática generalizada en todo nuestro país donde ante el incremento de hechos de violencia familiar y específicamente de agresiones contra la mujer o integrantes del grupo familiar, el Estado pretende reducirlos o evitarlos recurriendo al empleo del Derecho Penal sancionándolos con penas privativas de libertad efectivas, profundizando las divergencias y discrepancias al interior de la familia y poniendo en riesgo la unidad y continuidad de la misma.
Nuestro objetivo principal fue demostrar cuál era el efecto jurídico de la intervención del Derecho Penal en delitos leves por Violencia Familiar en el Distrito de Santa durante los años 2018 y 2019, empleando para ello los métodos correlacional y hermenéutico jurídico y como técnicas la entrevista, el análisis documental, el estudio de casos y la estadística descriptiva.
Concluyéndose que cerca de un 80 % de casos, luego de haber requerido la inversión de gran cantidad de recursos humanos y económicos terminaban por archivarse debido a que la parte agraviada por la escasa lesividad de los hechos ya no concurre al Despacho Fiscal para brindar mayor información, tampoco a ser evaluada médico legal o psicológicamente o por haber llegado a una conciliación tácita entre las partes, lo que significa que la criminalización de este tipo de conductas no ha contribuido a disminuir la violencia contra la mujer o integrantes del grupo familiar y más bien ha vulnerado la Política de protección de la familia prevista en el artículo 4º de nuestra Constitución Política al no estar orientada a superar las diferencias al interior de las mismas y lograr su consolidación, sino que se limita solamente a castigar hechos de escasa lesividad que bien pueden ser atendidos empleando otros mecanismos alternativos como el permitirse la institución jurídica del acuerdo reparatorio por única vez o despenalizándose dichas conductas para ser atendidas en la vía extrapenal, esto es, en un Juzgado de Paz Letrado para de esa manera brindar una justicia más célere y consensuada para el agraviado, así como menos lesiva para el investigado y la familia, evitándose además el incremento innecesario de la carga procesal tanto en Despachos Fiscales como Judiciales.
This research work entitled "LEGAL EFFECT OF THE INTERVENTION OF CRIMINAL LAW IN MINOR CRIMES OF FAMILY VIOLENCE IN THE DISTRICT OF SANTA 2018 - 2019" deals with a generalized problem throughout our country where, given the increase in acts of family violence and specifically of aggressions against women or members of the family group, the State intends to reduce or avoid them by resorting to the use of Criminal Law, sanctioning them with effective custodial sentences, deepening divergences and discrepancies within the family and putting at risk the unity and continuity of the same. Our main objective was to demonstrate what was the legal effect of the intervention of Criminal Law in minor crimes for Family Violence in the District of Santa during the years 2018 and 2019, using correlational and legal hermeneutical methods and as techniques the interview, the documentary analysis, case studies and descriptive statistics. Concluding that about 80% of cases, after requiring the investment of a large amount of human and economic resources, ended up being filed because the party injured by the scant harmfulness of the facts no longer attends the Fiscal Office to provide more information, nor to be evaluated medically, legally or psychologically, or for having reached a tacit conciliation between the parties, which means that the criminalization of this type of conduct has not contributed to reducing violence against women or members of the family group and rather has violated the Family Protection Policy provided for in Article 4 of our Political Constitution as it is not aimed at overcoming the differences within them and achieving their consolidation, but is limited only to punishing acts of little harm that may well be cared for using other alternative mechanisms such as allowing the legal institution of the reparatory agreement one-time or decriminalizing said conduct to be treated in the extra-criminal way, that is, in a Legal Justice of the Peace in order to provide a more celestial and consensual justice for the aggrieved, as well as less harmful to the investigated and the family, also avoiding the unnecessary increase of the procedural burden both in Fiscal and Judicial Offices.
