dc.descriptionIn this research we intend to contribute to the problem of transfer of immovable property, whether registered or not registered, to fundamentally address the right to property, the transfer of real property, the public nature of municipal autovalúes concepts that we develop doctrinally as well as we strengthen ourselves in consultation with the updated legislation in the matter. It is thus that this thesis that takes as title THE REGISTRAR AND THE GOOD FAITH IN THE MUNICIPAL AUTOVALUOS IN THE REINVINDICACION DE INMUEBLES ", tries to demonstrate in what way the municipal autovalúos, being documents issued by public officials, can detract from the Good Faith which is alleged by a subsequent purchaser but with an inscribed right. In this way, we consider it of the utmost importance to adequately evaluate Municipal self-vouchers because, because of their public nature, they are suitable means to distort this good faith of the later acquirer with registered right. This adequate valuation in the claims process will solve the very few cases in which the first acquirer never registered its right and would therefore be affected by the appearance of another subsequent acquirer with registered rightes_PE
dc.description.abstractEn el presente trabajo de investigación se pretende aportar en la problemática de las trasferencias de bienes inmuebles, inscritos o no inscritos, para abordamos fundamentalmente el derecho a la propiedad, la transferencia de bienes inmuebles, la naturaleza pública de los autovalúos municipales conceptos que desarrollamos doctrinalmente así como nos afianzamos en consulta con la legislación actualizada en la materia. Es así, que esta tesis que lleva como título EL ADQUIRIENTE REGISTRAL Y LA BUENA FE EN LOS AUTOVALUOS MUNICIPALES EN LA REINVINDICACION DE INMUEBLES”, pretende demostrar de qué manera los autovalúos municipales, al ser documentos emitidos por funcionarios públicos, pueden desvirtuar la Buena fe que alega un adquiriente posterior pero con derecho inscrito. De este modo consideramos de suma importancia valorar adecuadamente los autovalúos Municipales pues, por su naturaleza pública, son medios idóneos para desvirtuar esta buena fe del adquiriente posterior con derecho inscrito. Esta adecuada valoración en los proceso de reivindicación, resolverá los no muy pocos casos, en los que el primer adquiriente nunca inscribió su derecho y por lo tanto se vería afectado por la aparición de otro adquirente posterior con derecho inscritoes_PE
