dc.descriptionLa presente tesis realiza el análisis de la vulneración del derecho a la Tutela Jurisdiccional Efectiva del deudor alimentario por la aplicación del requisito de admisibilidad previsto en el artículo 565-A del Código Procesal Civil, de acreditar encontrarse al día en el pago de la pensión alimenticia para la admisión de la demanda de reducción de alimentos. En la primera parte se describe el marco metodológico empleado para la elaboración de la presente tesis. Se plantea la problemática, se establece el objetivo general y los objetivos específicos de la presente investigación, así como la justificación, los métodos y las técnicas de investigación. La segunda parte se refiere al marco teórico y se divide en tres capítulos. El capítulo uno describe el derecho de alimentos y su importancia con derecho fundamental; el capítulo describe el derecho a la Tutela Jurisdiccional Efectiva, sus manifestaciones procesales, su contenido y sus importancia como Derecho Constitucional; en el capítulo tres se analiza Ley N° 29486 que incorpora el artículo 565-A del Código Procesal Civil, que establece el requisito de acreditar encontrarse al día en el pago de la pensión alimenticia para la admisión de la demanda de reducción, variación, prorrateo o exoneración de la pensión alimenticia. En la tercera parte se exponen los resultados y su discusión, se presentan las conclusiones, respondiendo el objetivo general y específicos de la tesis; y se enuncian las recomendaciones para evitar la vulneración de la Tutela Jurisdiccional Efectiva del deudor alimentario.es_ES
dc.description.abstractThis thesis makes the analysis of the violation of the right to judicial protection of the food debtor Effective implementation of the requirement for admissibility under Article 565-A of the Civil Procedure Code, of proving to date in the payment of alimony Admission to the reduction in demand for food. In the first part the methodological framework used for the making of this thesis is described. The problem arises, the general objective and specific objectives of this research as well as the rationale, methods and research techniques is established. The second part concerns the theoretical framework and is divided into three chapters. Chapter one describes the right to food and its importance fundamental right; The chapter describes the right to judicial protection effective procedural demonstrations, contents and importance as a constitutional right; in chapter three Law No. 29486 which incorporates Article 565-A of the Civil Procedure Code, which establishes the requirement to demonstrate to date in the payment of maintenance for the admission of demand reduction, variation, it discusses apportionment or exemption of alimony. In the third part the results and discussion are presented, the findings are presented, answering the general and specific objective of the thesis; and set out recommendations to prevent violations of Effective judicial protection of the food debtor.es_ES
