dc.description.abstractLa aplicación garantista del artículo 23 del Código Penal exige que los operadores de justicia utilicen racionalmente las reglas de la dogmática penal para imputar individualmente responsabilidad penal a los sujetos que integran una organización criminal. Así, el objetivo principal en la investigación fue determinar si el título de intervención delictiva de coautoría no ejecutiva tiene capacidad de rendimiento para imputar responsabilidad penal al líder de una organización criminal que, con base en una división de funciones, se limita a realizar una contribución pre-ejecutiva al hecho típico, pero con un peso del aporte proporcional a la del coautor – ejecutor. Finalmente, aplicando métodos y técnicas, concluimos que es plausible la aplicación del título de imputación, debido a que la comisión conjunta requerida legalmente para la coautoría en relación con la lesión o puesta en peligro de bienes jurídico – penales debe interpretarse en el esquema de una división de funciones, en el cual el líder realiza una contribución esencial en la fase preparatoria del delito, mientras que el coautor – ejecutor lleva a cabo el hecho delictivo por propia mano, siguiendo la unidad de sentido establecida por el líder de la organización criminal.
dc.description.abstractABSTRACT The guaranteed application of Article 23 of the Criminal Code requires that justice operators rationally use the rules of criminal dogma to individually impute criminal responsibility to the subjects who make up a criminal organization, thus, the main objective in the investigation is to determine whether the title of criminal intervention of non-executive co-authorship has the capacity to impute criminal responsibility to the leader of a criminal organization that on the basis of A division of functions is limited to making a pre-executive contribution to the typical act, but with a weight of the contribution proportional to that of the co-perpetrator-executor.Finally, applying methods and techniques, we conclude that the application of the title is plausible, this is because the joint commission legally required for co-authorship in relation to the injury or endangerment of legal-criminal assets, must be interpreted in the scheme of a division of functions, in which the leader makes an essential contribution in the preparatory phase of the crime, while the co-perpetrator – executor carries out the criminal act by his own hand, following the unity of meaning established by the leader of the criminal organization.
