dc.description.abstractLa presente tesis investiga el momento oportuno para la resolución de excepciones perentorias en el proceso ordinario laboral peruano, para ello, los autores analizan criterios doctrinarios y jurisprudenciales, así como la legislación peruana y comparada con el único fin de poder determinar cuándo se debe resolver una excepción perentoria. La investigación utiliza primordialmente el método analítico, la técnica del fichaje y análisis del contenido para procesar y ordenar la información obtenida. Al haberse estudiado toda la información recabada, los autores concluyen que las excepciones perentorias planteadas en el proceso ordinario laboral peruano deben resolverse en la audiencia de juzgamiento, específicamente en la etapa de confrontación de posiciones, pues si esta es declarada fundada se vulneran los principios de celeridad y economía procesal; ello siguiendo la estructura de la Ley N° 29497- Nueva Ley Procesal de Trabajo. Sin embargo, se recomendó que dichas excepciones sean resueltas en audiencia de conciliación para que en la audiencia de juzgamiento se actúe con una relación jurídica procesal válida.
dc.description.abstractABSTRACT The present thesis investigates the opportune moment for the resolution of peremptory exceptions in the Peruvian ordinary Labor Process. To this end, the authors analyse doctrinal and jurisprudential criteria, as well as Peruvian and comparative legislation with the sole purpose of determining when a peremptory exception must be resolved. The research essentially utilizes the analytical method, the technique of file and content analysis to process and order the information obtained. From all the information gathered, the authors conclude that the peremptory exceptions raised in the ordinary Peruvian Labor Process must be resolved at the trial hearing, specifically in the confrontation stage, because if this is declared founded, the principles of procedural speed and procedural economy are violated; this following the tructure of Law No. 29497- New Labor Procedural Law. However, it was recommended that such exceptions be resolved in a conciliation hearing so that in the trial hearing a valid procedural legal relationship is established.
