dc.descriptionABSTRACT The objective of the present investigation was to determine how to achieve the application and primacy of the private autonomy of the parties in the leasing contract without ignoring the will, freedom and equality of the tenant. For the verification of the hypothesis, a sample constituted by 10 experts in financial leasing contract analysis divided into: 06 users and 04 financial entities was considered. As well as the statistical reports of the financial leasing contracts of the ASBAC, 2016-2017, and the regulations that regulate it. In order to obtain the information, the techniques of documentary analysis, the signing and the survey were used, with their respective data collection instruments. This information was organized and presented in tables and frequency figures. Likewise, the inductive-deductive, analysis-synthesis and hermeneutic methods were used to discuss the information obtained from the elements of the sample. The results allowed to conclude that the application and primacy of the Principle of Private Autonomy of the tenant, in the financial leasing contract within the framework of constitutionally regulated contractual freedom, is achieved by granting personal decision to the tenant in the free pact of the minimum insurance conditions that covers the goods subject of financial leasing, since Legislative Decree 299 is distorted, coerces the contractual freedom and imposes the financial obligation on the business need.es_PE
dc.description.abstractRESUMEN La presente investigación tuvo como objetivo determinar cómo lograr la aplicación y primacía de la autonomía privada de las partes en el contrato leasing sin desconocer la voluntad, libertad e igualdad del arrendatario. Para la verificación de la hipótesis se consideró una muestra constituida por 10 expertos en análisis del contrato leasing financiero dividido en: 06 usuarios y 04 entidades financieras. Así como los informes estadísticos de los contratos de leasing financiero de la ASBAC, 2016-2017, y la normatividad que lo regula. Para la obtención de la información se utilizaron las técnicas del análisis documental, el fichaje y la encuesta, con sus respectivos instrumentos de recolección de datos. Dicha información fue organizada y presentada en tablas y figuras de frecuencia. Asimismo, se utilizaron los métodos inductivo-deductivo, análisis-síntesis y hermenéutico para la discusión de la información obtenida de los elementos de la muestra. Los resultados permitieron concluir que la aplicación y primacía del Principio de Autonomía Privada del arrendatario, en el contrato de leasing financiero en el marco de la libertad contractual constitucionalmente regulado, se logra concediendo decisión personal al arrendatario en el pacto libre de las condiciones mínimas del seguro que cubra los bienes materia de arrendamiento financiero, puesto que el Decreto Legislativo 299 se encuentra tergiversada, coacta la libertad contractual e impone la obligación financiera sobre la necesidad empresarial.es_PE
