| dc.description | The present work arises before the question Is the right to effective Jurisdictional Protection to the victims of Family Violence in the proceedings processed before the Family Courts of the Superior Court of Justice of La Libertad during the years 2011 to 2013 been guaranteed? It is thus that the subject of the investigation refers to the shortcomings that are presented around the process followed in cases of family violence, hoping with this to contribute to the effective realization of the right to effective judicial protection for victims of Family Violence. The present thesis is structured in five parts: the first part corresponds to the preliminaries, the second part consists of an introduction to the research and the theoretical framework, the latter is divided into four chapters: the first chapter addresses general aspects of Family Violence, in the Second Chapter its legal treatment in the national, international and in the Comparative Law, in the Third Chapter the General Scope, antecedents, notions, subjects, content of the Effective Jurisdictional Protection, in the Fourth Chapter the Right to Effective Jurisdictional Protection of victims of family violence in the proceedings before the Family Courts; The Third Part is referred to as a Methodological Framework, which develops the way in which the research was carried out and how the data and results were interpreted, in addition to the methods and techniques used; The results of the investigation are recorded in Part Four, for which a study of thirty cases of Family Violence processed before the First Family Court of the Superior Court of Justice of La Libertad was carried out, as well as the analysis of the case study , The conclusions and recommendations, complementing this with the bibliography used and the annexes that have been added to the report, hoping to contribute to the legal community | es_PE |
| dc.description.abstract | El presente trabajo surge ante la interrogante ¿Se ha garantizado el derecho a la Tutela Jurisdiccional Efectiva a las víctimas de Violencia Familiar en los procesos tramitados ante los Juzgados de Familia de la Corte Superior de Justicia de La Libertad durante los años 2011 a 2013?, es así que la temática de la investigación está referida a las falencias que se presentan en torno al proceso seguido en los casos de violencia familiar, esperando con esto contribuir a que se efectivice el derecho a la tutela jurisdiccional efectiva a las víctimas de Violencia Familiar. La presente tesis está estructurada en cinco partes: La Primera Parte corresponde a los preliminares, la Segunda Parte consta de una introducción a la investigación y el marco teórico, éste último se encuentra dividido en cuatro capítulos: en el Primer Capítulo se abordan Aspectos generales de Violencia Familiar, en el Segundo Capítulo su tratamiento jurídico en el ámbito nacional, internacional y en el Derecho Comparado, en el Tercer Capítulo los Alcances Generales, antecedentes, nociones, sujetos, contenido de la Tutela Jurisdiccional Efectiva, en el Cuarto Capítulo el Derecho a la Tutela Jurisdiccional Efectiva de las víctimas de violencia familiar en los procesos seguidos ante los Juzgados de Familia; la Tercera Parte está referida Marco Metodológico, en la que se desarrolla la forma en la que se realizó el trabajo de investigación y cómo se interpretaron los datos y resultados, además se señalan los métodos y técnicas utilizados; en la Cuarta Parte se consignan los resultados de la investigación, para lo cual se realizó el estudio de treinta expedientes de Violencia Familiar tramitados ante el Primer Juzgado de Familia de la Corte Superior de Justicia de La Libertad, así mismo, el análisis del caso práctico, las conclusiones y recomendaciones, complementando esto con la bibliografía utilizada y los anexos que se ha agregado al informe, esperando contribuir a la comunidad jurídica | es_PE |
