dc.description.abstractLa presente tesis denominada “MODIFICACIÓN DEL ARTÍCULO 483° DEL CÓDIGO CIVIL Y EL DERECHO DEL OBLIGADO ALIMENTARIO A LA EXONERACIÓN DE PENSIÓN ALIMENTICIA” tiene como propósito la modificación del artículo 483° del Código Civil con la finalidad de establecer una exoneración automática de la pensión alimenticia por parte del obligado alimentario, con el objetivo de reducir la carga procesal existente en los Juzgados de Paz Letrado y garantizar el derecho a la tutela jurisdiccional efectiva. En la actualidad, en los juzgados de Paz Letrado existe un gran cargo rocesal con respecto a los procesos de exoneración de alimentos los cuales tardan más de un año en resolverse, lo que afecta el derecho del obligado alimentario a ser tratados con igualdad ante la ley. Asimismo, se exige que el obligado alimentario esté al día en el pago de las pensiones y presente una constancia de no adeudo como requisito de admisibilidad de su demanda, lo que limita su derecho a una tutela jurisdiccional efectiva. Por lo tanto, se busca demostrar que la exoneración automática de alimentos puede disminuir la carga procesal en los juzgados, garantizar la tutela jurisdiccional efectiva del obligado alimentario y promover los principios de celeridad y economía procesal.
dc.description.abstractASTRACT The present thesis called "MODIFICATION OF ARTICLE 483° OF THE CIVIL CODE AND THE RIGHT OF THE OBLIGATED ALIMENTARY TO EXEMPTION FROM ALIMENTARY PENSION" has the purpose of modifying article 483° of the Civil Code in order to establish an automatic exoneration of alimony by the food obligee, with the aim of reducing the existing procedural burden in the Justices of the Peace Lawyer and guaranteeing the right to effective judicial protection. Currently, in the courts of Paz Letrado there is a great procedural burden with respect to the processes of exoneration of food which take more than a year to resolve, which affects the right of the food obligee to be treated equally before the law . Likewise, it is required that the obligated alimony be up to date in the payment of pensions and present a certificate of non-debt as a requirement for the admissibility of his claim, which limits his right to effective judicial protection. Therefore, it seeks to demonstrate that the automatic exoneration of maintenance can reduce the procedural burden in the courts, guarantee the effective judicial protection of the food obligor and promote the principles of speed and procedural economy.
