dc.descriptionThis thesis titled: “EXPERT EVIDENCE IN ACCREDITATION OF THE FELONY PSYCHOLOGICAL INJURIES” has the purpose to demonstrate the importance of the expert evidence based on specialized technical instrument to determine the psychic damage and its immediate and necessary implementation for the purpose of not generating impunity with the archive of fiscal cases about the felony of psychological injuries. In our country, violence against woman and members of the familial group is not considered as an autonomous felony, however, the law N° 30364 penalizes such violence incorporating assumptions that refers to violence acts against woman and members of the familial group inside of penal types of minor injuries and serious injuries, as well as incorporating new felonies, such is the case of aggressions felony against woman or members of the familial group, which is typified in the Article 122 - B. In that sense, familial violence and the felony of psychological injuries have been considered inside of the theoretical framework in different chapters. This research work is divided in three parts, which are introduction, theoretical framework and methodological framework, besides, it contains the results, conclusions and recommendations. Finally, it is important to stick out one of the conclusions that refers to ineptitude and a little criterion of legislators when they modify or incorporate penal rules without an appropriate analysis and a real solution to this problematical violence against woman and the members of the familial group; on the contrary, they generate impunity. dc.description.abstractLa presente tesis titulada: “LA PRUEBA PERICIAL EN LA ACREDITACIÓN DEL DELITO DE LESIONES PSICOLÓGICAS”, tiene como finalidad demostrar la importancia de la prueba pericial basada en instrumento técnico oficial especializado para determinar el daño psíquico y su necesaria implementación inmediata a fin de no generar impunidad con el archivo de los casos fiscales por el delito de lesiones psicológicas. En nuestro país, la violencia contra la mujer y los integrantes del grupo familiar no es considerada como delito autónomo, sin embargo la ley N° 30364 logra sancionar dicha violencia incorporando supuestos que hacen referencia a los actos de violencia contra la mujer y los integrantes del grupo familiar dentro de los tipos penales de lesiones leves y lesiones graves, así como incorporando nuevos delitos, tal es el caso del delito de Agresiones en contra de las mujeres o los integrantes del grupo familiar, el cual se encuentra tipificado en el Artículo 122° - B. En ese sentido, se ha considerado dentro del marco teórico a la violencia familiar y al delito de lesiones psicológicas en diferentes capítulos. El presente trabajo de investigación se divide básicamente en tres partes, las cuales son introducción, marco teórico y marco metodológico, además de contener los resultados, discusión de resultados, conclusiones y recomendaciones. Finalmente, cabe resaltar una de las conclusiones que hace referencia a la ineptitud y poco criterio de los legisladores al modificar o incorporar normas penales sin realizar un adecuado análisis y sin dar una real solución a la problemática de la violencia contra la mujer y los integrantes del grupo familiar, sino por el contrario, generando con ello impunidad.
