dc.descriptionABSTRACT This thesis entitled "Assumptions for the application of procedural separation in circumstances modifying criminal liability", had as a general objective how the application of procedural untying is reconcilable with the modifying circumstances of criminal liability in Trujillo, in the 2016 period -2018. To formulate and contrast the hypothesis, we worked on the thematic dispersion of the items referring to the variables of the problem; gathering information from the study sample constituted by 9 judgments issued by the First Supraprovincial Criminal Court of Trujillo, as well as by 01 relevant judgment issued by the Eighth Criminal Superior Court of Trujillo, regarding the manner in which the application of the dissociation procedural is reconcilable with the modifying circumstances of criminal liability in Trujillo in the period 2016-2018, together with the bills and laws regarding the regulation of procedural unbundling in national and international legislation. For this purpose the techniques were used of the observation and the documentary analysis, with their respective instruments of data collection, Also, for the discussion of the results the scientist was used, as well as the general methods of science: inductive - deductive and analysis - synthesis; and the particular methods: hermeneutic and exegetical, It was concluded that the application of procedural separation is reconcilable with the modifying circumstances of criminal liability in Trujillo in the period 2016-2018 because its application occurred in rational assumptions such as: 1) Before an incorrect legal qualification, 2) "Incorrect legal interpretation of the facts", and 3) "Discrepancy in the legal interpretation of the facts".es_PE
dc.description.abstractRESUMEN La presente tesis titulada “Supuestos para la aplicación de la desvinculación procesal en circunstancias modificativas de la responsabilidad penal”, tuvo como objetivo general cómo la aplicación de la desvinculación procesal es conciliable con las circunstancias modificativas de la responsabilidad penal en Trujillo, en el periodo 2016-2018. Para formular y contrastar la hipótesis, se trabajó en la dispersión temática de los ítems referidos a las variables del problema; recabando información de la muestra de estudio constituida por 9 sentencias emitidas por el Primer Juzgado Penal Colegiado Supraprovincial de Trujillo, así como por 01 sentencia relevante emitida por el Octavo Juzgado Penal Colegiado Supraprovincial de Trujillo, respecto a la manera en que la aplicación de la desvinculación procesal es conciliable con las circunstancias modificativas de la responsabilidad penal en Trujillo en el periodo 2016-2018, conjuntamente con los proyectos de ley y leyes respecto a la regulación de la Desvinculación Procesal en la legislación nacional e internacional. Para ello se utilizaron las técnicas de la observación y el análisis documental, con sus respectivos instrumentos de recolección de datos, Así también, para la discusión de los resultados se utilizó el científico, así como los métodos generales de la ciencia: inductivo - deductivo y análisis - síntesis; y los métodos particulares: hermenéutico y exegético, Se concluyó que la aplicación de la desvinculación procesal sí es conciliable con las circunstancias modificativas de la responsabilidad penal en Trujillo en el periodo 2016-2018 debido a que su aplicación se dio en supuestos racionales tales como: 1) Ante una incorrecta calificación jurídica, 2) “Incorrecta interpretación jurídica de los hechos”, y 3) “Discrepancia en la interpretación jurídica de los hechos”.es_PE
