dc.description.abstractEl presente trabajo de investigación aborda de manera puntual uno de los temas más polémicos en la actualidad en nuestro Ordenamiento Jurídico: “La modificación de los artículos 395 y 400 del Código Civil Peruano, debido a la aplicación del control difuso”, en los casos, donde el padre, impugna el reconocimiento de un hijo extramatrimonial, que efectuó, por dolo inducido de la madre. Teniendo en cuenta la evolución en el campo del derecho, debido a los cambios en las necesidades de la sociedad, actualmente, es más frecuente la aplicación del control difuso por parte de los jueces peruanos, en los artículos 395 y 400 del Código Civil Peruano, el primero prescribe: “El reconocimiento no admite modalidad y es irrevocable”, mientras que el segundo, prescribe: “El plazo para negar el reconocimiento es de noventa días, a partir de aquel en que se tuvo conocimiento del acto”; por lo que consideramos que la solución más adecuada en estos tipos de casos, sería la modificación de dichos artículos con la finalidad de generar seguridad jurídica para los justiciables
dc.description.abstractABSTRACT This paper deals in a timely manner with one of the most controversial issues at present in our Legal System: “The non-existence of a uniform norm or an express law with which the cases in which the father challenges the recognition can be properly regulated of an extramarital son that he himself made by induced mischief of the mother; so the judge’s solution is left to the judge’s solution, Taking into account the evolution that is generated day by day in the field of law due to changes in the needs of society; Currently, the application of diffuse control by Peruvian judges is more frequent, leaving in disuse Article 395 and 400 of the civil code, which prescribes that: "Recognition does not admit modality and is irrevocable", while the second prescribes: "The term to deny the recognition is ninety days, starting from the one in which the act was known"; Therefore, we consider that the most appropriate solution in these types of cases would be the modification of said articles in order to generate legal security for the defendants
