Abstract
El presente trabajo de investigación se ejecutó con la finalidad de optimizar el sistema procesal con el propósito de asegurar un acceso efectivo a los órganos jurisdiccionales para los consumidores, facilitando así la obtención de indemnizaciones por daños y perjuicios, y restaurando el equilibrio en la protección de los derechos de los consumidores, para ello, se empleó un tipo de investigación básica o teórica y un diseño descriptivo. Dentro de los principales resultados se obtuvo que las barreras que limitan el acceso de los consumidores son barreras legales, procedimentales y económicas; de igual manera, se determinó es necesario implementar una reforma legal y procedimental para agilizar los procesos judiciales, asimismo, se determinó que las buenas prácticas de derecho comparado demuestran que los consumidores acceden a la justicia y la obtención de indemnizaciones de manera célere. Concluyendo de manera general que es necesario optimizar el sistema procesal con la finalidad de asegurar el un acceso efectivo a los órganos jurisdiccionales para los consumidores, facilitando así la obtención de indemnizaciones por daños y perjuicios, modificando para ello el artículo 125 del Código de Protección y Defensa del Consumidor.
Abstract This research work was carried out with the aim of optimizing the procedural system in order to ensure effective access to the courts for consumers, thus facilitating the obtaining of compensation for damages, and restoring the balance in the protection of consumer rights. To this end, a type of basic or theoretical research and a descriptive design were used. Among the main results, it was obtained that the barriers that limit consumer access are legal, procedural and economic barriers; likewise, it was determined that it is necessary to implement a legal and procedural reform to expedite judicial processes. Likewise, it was determined that good practices in comparative law demonstrate that consumers access justice and obtain compensation in a prompt manner.
